Acceptance of Terms of Use

The following Terms of Use apply to all transactions with www.printngift.com, hereafter referred to as Website.

The placing of an order indicates your unequivocal acceptance of these Terms of Use.

PrintnGift Pte Ltd with registered office at 10, Anson Road, #02-81, International Plaza, Singapore 079903, and company registration number 201506892M, hereafter referred to as PrintnGift, owner of the Website, through these Terms of Use establish the rules to be observed by the Contracting Party, that is, the natural persons or legal entities that access the Website for online PrintnGift services.

This service is aimed at customers who want to print their files in digital format, utilizing the services provided in our Website. By accessing the Website, as well as by purchasing the products and / or services, the Contracting Party agrees to all the terms and conditions hereof.

PrintnGift reserves the right to make changes to this Website and to these Terms of Use at any time without prior notice. You should review these Terms of Use each time you access this Website.

The Contracting Party, in accordance with the Terms of Use, agrees to provide true, accurate, current and complete information, as well as to maintain and immediately update such registration information to keep it true, accurate, current and complete.

The Contracting Party is aware that accessing the Website or hiring the services through its email address or username and password, automatically implies that the Contracting Party is assuming full responsibility for its actions.

If any information provided by the Contracting Party is false, inaccurate, out of date or incomplete, or if PrintnGift has reasons and grounds to suspect that such information could be untrue, inaccurate, out of date or incomplete, PrintnGift will be entitled to immediately suspend or terminate, regardless of notification, the purchase request by the Contracting Party, as well as any future service hiring thereof.

The Contracting Party shall provide its electronic address (email address) to be used in the Website and to receive the messages arising from his registration on the mentioned Website. The Contracting Party will be fully responsible for any activity that may occur within the period of registration. The electronic address provided by the Contracting Party will be used to identify him.

The Contracting Party also agrees that we may provide all legal communications and notices to you electronically by posting them on our Website or, at our election, by sending an e-mail to the e-mail address you provided to us when you registered at our website. You may withdraw your consent to receive communications from us electronically by contacting customer care. However, if you withdraw your consent to receive our communications electronically, you must discontinue your use of your account.

All orders are subjected to actual stock and service availability. PrintnGift has the full right to replace products or services ordered with alternatives upon getting verbal or written confirmation from the clients. For products and services that cannot be replaced, PrintnGift will contact the clients to provide the option to cancel the orders. If full payment has been made, the clients will be refunded of the selected products or services not delivered.

  • Products

PrintnGift reserve the right to alter any details of their products advertised without notice and while every effort is made to describe goods accurately in the advertisement no warranty is given as to accuracy and no responsibility will be accepted for error or mis-description of the goods and any resulting loss. All of our products are sold on an “as is” basis and each product may vary in color, size, design, type, and shape from batch to batch

  • Images

Product images are for illustrative purposes only and may differ from the actual product. Due to differences in devices and screens, colours of products may also appear different to those shown on the site.

  • Supplied Customer Artwork in ‘Print-Ready’ format

All artwork supplied by customers must be supplied in CMYK format. PrintnGift cannot be responsible for any colour shift that may occur when converting from RGB to CMYK.

All artwork must be supplied as 300dpi Hi-Res PDF’s. PrintnGift is not responsible for images that may print blurred or pixelated due to customer supplied artwork if its less than 300dpi. PrintnGift require 3mm bleed on all edges if the document requires this. If you are unsure of the term ‘bleed’ then please call and speak to one of our sales staff. If the artwork supplied is not ‘Print Ready’ then PrintnGift will contact you in order for you to re-supply or to make amendments and endeavour to get your order into print as soon as possible.
In most cases PrintnGift will amend the artwork without charge if it is a minor amendment. However, PrintnGift reserves the right to charge for alterations which cannot be rectified quickly – but prior to such alteration, PrintnGift will advise of any costs of alteration. Any delay in the artwork not being supplied in ‘Print Ready’ format may lead to adelay, especially for orders placed under our ‘Next Day Delivery’ service. In that event, PrintnGift shall not be liable whatsoever for any loss or damage resulting or arising from such delay.

  • Price Variations and Tax

Price estimates are based on PrintnGift current costs of production and, unless otherwise agreed, are subject to amendment on or at any time after acceptance, where such amendment is required in order to meet any rise or fall in such costs.

PrintnGift reserves the right to charge the amount of GST payable whether or not included on the estimate or invoice.

  • Complaints

Any complaints must be made within 24hours of receiving your goods. Any complaints made after this time period are void of any right to refund or reprint. PrintnGift have right to resolve any complaint within our own discretion and PrintnGift will not be liable for any loss of income, loss of profits, loss of markets, loss of reputation, loss of customers, loss of use, loss of an opportunity even if PrintnGift had knowledge that such damages or loss might arise or for any indirect, incidental, special or consequential damages or loss howsoever arising including without limitation breach of contract, negligence, wilful act or default.

  • Printing Defects

Customer must notify PrintnGift in writing (via email) within 24 hours of delivery of any defects discovered in the finished goods. In order to receive replacements Customer must return 95% of the delivered product within 7 days of delivery. PrintnGift shall not be liable for any costs, expenses incurred by the customer or any other person or third party arising directly or indirectly out of any print error. In the event that PrintnGift has printed a document incorrectly and it be found to be our fault then PrintnGift will supply a full re-print without cost to the customer. If the customer wishes to alter the artwork prior to the re-print then this will be treated as a new order and be consequently charged for.

  • Proofs

Due to differences in equipment, paper, inks and other conditions between color proofing and production runs, a reasonable variation in color between color proofs and the completed job will be deemed acceptable unless otherwise agreed made in writing.

  • Copyright

The Contracting Party is solely responsible for the use of Content in combination with any other images, graphics, text or other materials the Contracting Party incorporate into his Products. The Contracting Party agrees that he will not include any text, image, design, trademark, service mark, or any copyrighted work of any third party in his Products unless he has obtained the appropriate authorizations and license from the owners.

The Contracting Party warrant that his Products do not infringe upon any rights of any third party, including copyright, trademark, right of publicity or privacy, and will not libel or defame any third party, and that he has all required rights or permissions necessary to incorporate third party material into his Products. By placing an order on this Site, the Contracting Party warrant that he has all necessary permission, right and authority to place the order and he authorizes PrintnGift to produce the Products on his behalf.

  • Disputes

In the event of any dispute as to the quality or manner of the products or services provided by PrintnGift, PrintnGift and the Contracting Parties will use reasonable efforts to resolve such dispute. The foregoing will not be construed in any way to prohibit or to delay the exercise of any other rights or remedies afforded either party hereunder or by law.

  • Limitation of Liability

PrintnGift Pte Ltd will not be liable in contract or in tort (including negligence) to the customer for incidental or consequential damages, arising out of or resulting from anybody’s performance or non-performance of our obligations.

PrintnGift Pte Ltd shall not be liable for any form of financial losses, cost, expenses, damages and/or other economic damages. The Contracting Party agrees that the Contracting Party will not hold PrintnGift Pte Ltd responsible for any and all loss, cost, expense, and damages (including legal costs) on account of any and all manner of claims, demands, actions, and proceedings that may be instituted against PrintnGift Pte Ltd on grounds alleging that the said work violates any copyrights, trademarks, service marks, or is scandalous, or invades any person’s right to privacy or other personal rights.

PrintnGift warrants to the customers that all products or services purchased from PrintnGift through our Website is of satisfactory quality.

PrintnGift’s liability in connection with any products or services purchased through our Website is strictly limited to the purchase price of that products or services.
Unless otherwise stated, all products or services warranty will be covered by the respective brand owner.

  • Claims

All claims in respect of work, or the quality or quantity thereof, shall be made in writing within 14 days of receipt by the customer. In the absence of such a claim, the work shall be deemed to have been received, checked and accepted as fully complying with the customer’s specifications.

  • Cancellations and Refunds

PrintnGift Pte Ltd and its affiliated company (S) will not refund any money for the orders that were shipped or were cancelled after the order has been processed.

  • Personal Data

We will not use your personal data for any purpose other than those required to perform or provision of the services and our obligations herein, responding to queries, requests, applications and feedback and/or to third party service providers, agents and other organisations we have engaged to legitimately perform any of the services herein. We may retain your personal data for as long as it is necessary to fulfill the purpose for which it was collected or as required or permitted by applicable laws. We will cease to retain your personal data or remove the means by which the data can be associated with you, as soon as it is reasonable to assume that such retention no longer serves the purpose for which the personal data was collected and is no longer necessary for legal or business purposes.
